1. Binding Agreement

By registering or purchasing through our platform, you enter into a legally binding agreement with Hari Krishna Exports Pvt. Ltd. These Terms govern all your interactions with us and our affiliates, now and in the future. In case of any conflict with guidelines of our affiliated companies, their guidelines shall take precedence.

2. Diamond Purchases

Selecting a diamond on our website constitutes an offer to purchase, subject to availability.

As inventory is shared between our online and physical sales divisions, it is possible a stone may be sold moments before your order is placed. We appreciate your understanding in such rare cases.

All purchases are subject to these Terms, the seller’s specific guidelines, and any applicable conditions displayed on the platform.

3. Right to Modify

We reserve the right to amend, update, or remove any clause of these Terms at our sole discretion, without prior notice.

4. Ownership & Access

• Website Ownership: hk.co is owned and managed exclusively by Hari Krishna Exports Pvt. Ltd.
• Content Ownership: All content—including text, design, logos, graphics, videos, software, and images—is the intellectual property of HKE.
• Permitted Use: Registered users may view, download, and print materials solely for personal, non-commercial use. Content must not be modified.
• Restrictions: Any commercial use, reproduction, distribution, or third-party sharing without written approval from HKE is strictly prohibited and may result in legal action.

5. Lawful Use

Access to our website must be strictly lawful. You agree not to post, transmit, or share any content that is unlawful, abusive, defamatory, obscene, or otherwise objectionable. Login credentials and access rights are non-transferable.

6. Password Security

You are solely responsible for maintaining the confidentiality of your password. Any transactions made using your login will be considered authorized by you. Hari Krishna Exports Pvt. Ltd. will not be liable for unauthorized access arising from compromised passwords.

7. Pricing & Sale Terms

• Advance Payment: All confirmed orders must be paid in advance.
• Fair & Fixed Price Policy: Prices are non-negotiable and confirmed only upon order acceptance.
• Corrections: We reserve the right to correct errors (including pricing or product descriptions) even after an order has been placed.
• Extra Services: Any additional services requested by the buyer will incur separate charges.

8. Payment

• Deadline: Full payment must be received within five (5) business days of order confirmation. Orders without payment within this period will be cancelled.
• Currency: Transactions are accepted in US Dollars (USD) only.
• Local Taxes: Any applicable taxes are the responsibility of the purchaser.

9. Shipment & Delivery

• First Order Benefit: Your first business transaction with us is shipped free of charge.
• Dispatch: Orders are shipped only after payment confirmation.
• Courier Partners: Brinks, Malca Amit, BVC Express, PS, or FedEx (subject to prior approval).
• Insurance: All shipments are insured door-to-door by the courier service provider.
• Limitations: HKE reserves the right to decline shipments to certain international destinations.

10. Shipping & Handling Charges

• Invoices below USD 15,000: Minimum shipping charge of USD 100.
• Invoices above USD 15,000: Free shipping (subject to courier and destination terms).
• Coverage: Charges cover transport from Mumbai, India, to the designated international airport. Beyond this, the buyer bears costs for local clearance and delivery.

11. Cancellation of Orders

• Orders are reconfirmed by our representative after placement.
• Once shipped, orders cannot be cancelled.
• Orders not paid within 5 business days of confirmation will automatically expire.

12. KYC Compliance

• Mandatory Documents: Customers must provide valid identity, address proof, and business registration documents (for corporate clients).
• Data Privacy: All information is treated confidentially and used only for compliance and regulatory purposes.
• Non-Compliance: Failure to provide required documents may result in suspension or termination of services.
• Policy Updates: HKE may revise KYC requirements in line with regulatory updates.

13. Data Retention

We retain personal data only as long as necessary to fulfil business, legal, and regulatory purposes. In some cases, anonymized data may be used indefinitely for research and statistical purposes.

14. Governing Law

All transactions and disputes are subject exclusively to the jurisdiction of Mumbai, India.
